Warranty & Returns Policy
This Warranty & Returns Policy ('Policy') supplements and forms part of the TideLine Power Terms & Conditions and sets out in detail how TideLine Power ('Company', 'we', 'our', 'us') handles warranty cover, faults, and returns for Products purchased from us. This Policy should be read together with our Terms & Conditions and Privacy Policy. Nothing in this Policy excludes, restricts or modifies any right or remedy conferred on a consumer under the Australian Consumer Law (ACL), contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other applicable law that cannot lawfully be excluded. Where any part of this Policy is inconsistent with the ACL, the ACL prevails.
Part A — Warranty Policy
1. Overview
TideLine Power designs, assembles and manufactures a range of electrical products in-house ('In-House Manufactured Products'), and also supplies Products sourced from third-party manufacturers and brands ('Third-Party Products'). Because the applicable warranty differs depending on the origin of the Product, this Policy separates warranty cover into two categories, set out in clauses 2 and 3 below. Your invoice, packing slip, or product listing will indicate whether a Product is an In-House Manufactured Product or a Third-Party Product. If you are unsure which category applies to a Product you have purchased, please contact us and we will confirm.
2. In-House Manufactured Products — 12 Month Warranty
All Products that are designed, assembled or manufactured in-house by TideLine Power are covered by our own express warranty for a period of twelve (12) months from the date of original purchase, as evidenced by your proof of purchase ('In-House Warranty'). The In-House Warranty covers Products that fail, malfunction or develop a fault due to defective materials, defective workmanship, or a manufacturing defect arising during our in-house assembly or manufacturing process, when the Product has been installed, used and maintained in accordance with the instructions provided and within its rated specifications. Where a valid claim is made under the In-House Warranty, we will, at our discretion, and subject to our assessment of the fault:
● repair the Product using new or refurbished parts of equivalent quality and function; or
● replace the Product with the same or a comparable product of equivalent quality and function; or
● provide a partial or full refund of the original purchase price, where repair or replacement is not reasonably practicable.
The In-House Warranty is provided by TideLine Power in addition to, and does not limit or exclude, your rights under the ACL. Where a fault amounts to a major failure under the ACL, you retain your right to choose between a refund and a replacement, regardless of any remedy we might otherwise offer under this clause. The 12-month warranty period runs from the date of original purchase and is not extended or restarted by any repair or replacement provided during that period, except that any replaced component is itself covered for the balance of the original warranty period or ninety (90) days from the date of replacement, whichever is longer.
3. Third-Party Products — Manufacturer Warranty
Products supplied by TideLine Power that are manufactured by a third party are covered by the warranty offered by that manufacturer or brand, the terms and duration of which will be provided with the Product, referenced on the product listing, or made available on request prior to purchase. For Third-Party Products, we will assist you in facilitating a warranty claim with the relevant manufacturer or distributor, including by providing proof of purchase documentation and liaising with the manufacturer on your behalf where reasonably practicable. However, the ultimate assessment of a warranty claim for a Third-party Product rests with the manufacturer, in accordance with the terms of that manufacturer's warranty. Where a Third-Party Product does not meet a consumer guarantee under the ACL, you may also have rights directly against TideLine Power as the supplier, independently of the manufacturer's warranty, as set out in clause 6 below.
4. What the Warranty Does Not Cover
Neither the In-House Warranty nor any manufacturer warranty passed through by us covers loss, damage or failure caused by or resulting from:
● misuse, abuse, negligence, or use of the Product other than as intended or instructed;
● unauthorised modification, disassembly, alteration or repair by any person other than TideLine Power or an authorised repairer;
● incorrect, non-compliant, or unlicensed installation, including DIY installation not carried out in accordance with instructions and applicable standards;
● overloading, over-voltage, incorrect polarity, or use outside the Product's rated specifications;
● corrosion, moisture or water ingress, salt exposure, or exposure to conditions beyond the Product's stated environmental rating;
● accidental damage, impact damage, fire, or damage caused by an external electrical fault not attributable to the Product;
● failure to perform reasonable and recommended maintenance, cleaning or inspection;
● normal wear and tear, including the natural degradation of consumable components such as fuses, seals, gaskets, connectors and terminals over time;
● use of the Product with incompatible components, accessories or systems not supplied or approved by us;
● failure to follow instructions, warnings or safety information provided with the Product or in any accompanying Schematic. A warranty claim may also be declined, or the cost of assessment and return freight charged to you, where our inspection determines that the Product is not faulty, or that the fault falls within one of the exclusions listed above.
5. Making a Warranty Claim
To make a warranty claim, please contact us as soon as reasonably possible after you become aware of the fault, and provide the following information:
● your proof of purchase (invoice, order confirmation, or receipt);
● a clear description of the fault and when it first occurred;
● photographs or video of the fault or damage, where practicable;
● the Product's serial number, model, or batch identifier, where applicable.
Depending on the nature of the fault, we may ask you to return the Product to us for inspection and testing, request that a photograph or video be provided in lieu of return, or arrange an inspection of the Product at your location. We will advise you of the applicable process and who bears the cost of return freight once we have reviewed your claim, in accordance with clause 6 below. We aim to assess and respond to warranty claims within a reasonable time, generally within ten (10) business days of receiving all required information and, where applicable, the returned Product.
6. Cost of Returning Products for Warranty Assessment
Where a warranty claim is found to be valid, we will cover the reasonable cost of return freight for the faulty Product, and the cost of shipping any repaired or replacement Product back to you. Where a warranty claim is found not to be valid (for example, because the fault falls within an exclusion in clause 4, or no fault is found on inspection), you will be responsible for the reasonable cost of return freight and, where applicable, the cost of shipping the Product back to you.
7. Your Rights Under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a good or service, you are entitled to choose a refund or replacement for the good, or to cancel the service contract and receive a refund for the unused portion, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure, or to have a service resupplied or refunded if it fails to be provided with due care and skill. Nothing in this Policy, including the 12-month In-House Warranty period or any manufacturer warranty duration, limits the period during which the ACL consumer guarantees apply, as that period is determined by law based on factors such as the nature of the goods, their price, and what a reasonable consumer would expect.
Part B — Returns Policy
8. Our General Approach: No Change-of-Mind Returns
Because many of our Products are electrical components, custom-configured items, or safety-related parts that cannot be resold once opened, installed, or used, TideLine Power does not offer refunds, exchanges or returns for change of mind. This includes situations where you have simply changed your mind, ordered the wrong item, found a lower price elsewhere, or no longer require the Product. We encourage you to check compatibility, specifications and quantities carefully before purchasing, and to contact us prior to placing an Order if you are at all unsure whether a Product is right for your application. See also clause 8 (Product Suitability) of our Terms & Conditions. This no-change-of-mind approach does not apply, and does not limit your rights, where there is a genuine issue with the Product, as set out in clause 9 below.
9. Returns Where There Is a Genuine Issue
We will accept a return, and provide a repair, replacement or refund as appropriate, where there is a genuine issue with a Product, including where the Product:
● is faulty, defective, or fails prematurely under normal use;
● was delivered damaged or in a materially incomplete condition (for example, missing parts);
● is not of acceptable quality, having regard to its price, description and intended use;
● does not match the description provided at the time of sale;
● is not fit for a purpose that you made known to us prior to purchase, and for which we confirmed suitability; or
● was supplied to you in error (for example, we shipped the wrong item).
A 'genuine issue' does not include a change of mind, ordering the incorrect item or quantity where the item as delivered matched your Order, or a Product that has been damaged, misused or incorrectly installed after delivery (see clause 4 above). Where a genuine issue is identified, we will follow the same claim process set out in clause 5 above (proof of purchase, description of the issue, photographic evidence, and where necessary return of the Product for inspection), and will not charge you for return freight where the issue is confirmed as genuine.
10. Custom Schematics and Made-to-Order Items
Custom wiring Schematics, bespoke wiring assemblies, and Products configured or manufactured specifically to your stated requirements are not eligible for return on the basis of change of mind, given their bespoke nature. Such items remain eligible for a remedy under clause 9 where there is a genuine issue, such as a manufacturing defect or an error in fulfilling your confirmed specification.
11. Condition of Returned Products
Where you return a Product under this Policy, please return it, where reasonably possible, with all original accessories, packaging and documentation, and in a clean and safe condition for handling and assessment. This clause does not apply to, or reduce, your rights where the condition of the Product is itself the subject of the fault being claimed (for example, physical damage on arrival).
12. Refund Method and Timing
Where a refund is approved under this Policy, it will be processed using the same payment method used for the original purchase, unless otherwise agreed, and will generally be processed within a reasonable time and in any event within ten (10) business days of the refund being approved. Where only part of an Order is affected by a genuine issue, the refund or replacement will generally be limited to the affected Product(s), unless the fault or issue affects your ability to make reasonable use of the Order as a whole.
